Terms of Service

The Service is operated by Ogua ("we", "us", "our"). Legal and listing notices: legal@ogua.cc. Privacy questions: privacy@ogua.cc.

These Terms work together with our Safety tips. If the Safety tips and these Terms conflict, these Terms control.

What the Service is

Ogua is a local marketplace for Cape Coast. Sellers post listings with photos, a price, and a location. Buyers browse listings, message the seller, and arrange to meet. Posting a listing is free.

Ogua is a meeting place, not a party to the sale. We do not deliver goods, hold funds, escrow money, verify payment, guarantee that a transaction completes, or act as a party to any agreement between a buyer and a seller. A listing is not an endorsement, certification, inspection, or guarantee of quality or safety.

Safety tips on the Service are guidance only. You are responsible for arranging public meet-ups, inspecting items before you pay, and deciding whom to trust.

We may change, pause, or discontinue features, including categories, filters, and board ordering.

Eligibility

• You must be at least 18 years old and able to form a binding contract.
• If you use the Service for a company, you represent that you have authority to bind that company, and "you" includes that company.
• You may not use the Service if you are prohibited from receiving services under applicable law, including trade sanctions.

No payment collection

Ogua does not charge for listings and does not collect, hold, escrow, or process payment. There is no checkout, no stored balance, no voucher, and no credit system. We never ask for card or bank details, and we never ask anyone to send money on our behalf.

The price shown on a listing is set by the seller. Any agreement to buy, sell, or pay is made directly between the buyer and the seller. Ogua is not a party to that agreement, is not entitled to any part of it, and does not mediate disputes over it.

Any message asking you to pay a "verification", "membership", or "refund" fee on behalf of Ogua is fraudulent. Do not send money to such a request, and report it to legal@ogua.cc. We will never ask you to pay to list, to publish, or to keep a listing live.

No refunds from Ogua

Because Ogua does not collect payment, it cannot refund a purchase. Any refund, return, or dispute about an item or a transfer of money is between the buyer and the seller. Contact the seller directly, and report suspected fraud to the authorities.

Listings must be accurate and lawful

You may only list items you own or are authorized to sell. Listings must describe the item honestly, including condition, price, and meet-up area. Fake details, stolen goods, impersonation, or listings meant to scam buyers or sellers are grounds for removal.

Your warranties

By submitting a listing, message, or report, you represent and warrant that:

• You have the right to sell or offer the item you list.
• Your listing and activity comply with applicable laws, including consumer, advertising, privacy, and intellectual-property rules.
• You are not impersonating another person, brand, or company.
• The listing is not malware, phishing, a scam, or primarily intended to deceive visitors.
• The information you submit is accurate, and you will keep it accurate.

Prohibited listings and use

In addition to the Safety tips, you may not list or use the Service for:

• Illegal goods or services; weapons where unlawful; drugs; stolen property; or anything you are not allowed to sell.
• Sexual, pornographic, or adult content used as the primary offer; or content that exploits children.
• Content that is fraudulent, defamatory, harassing, hateful, or violent.
• Counterfeit goods, unauthorized copies, or other infringement of copyright, trademark, or other rights.
• Interfering with the Service: scraping beyond ordinary browsing, manipulating counts, bypassing rate limits, automated abuse, or reverse engineering except as allowed by mandatory law.

Our right to remove listings

We may refuse, delay, edit, recategorize, hide, or permanently remove any listing, message, account access, or related page, with or without notice, including where we believe these Terms, the Safety tips, or the law may have been broken; where a rights holder complains; where ownership or accuracy is unclear; or where we think the listing creates legal, safety, or reputational risk.

License you grant us

You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, adapt (for sizing, formatting, and display), and publicly display your listing text, photos, and profile details for as long as needed to operate and promote the Service. Marketplace messages stay private to the people in that conversation unless we must review them for safety, abuse, or legal reasons, or you choose to share them elsewhere. Complaints and rights notices

If you believe a listing infringes your copyright, trademark, publicity, or other rights, email legal@ogua.cc with: (1) your name and contact details; (2) the listing URL on Ogua; (3) a description of the problem; and (4) a statement that the notice is accurate and that you are the rights holder or authorized to act. We may remove or restrict the listing while we review the notice.

No endorsement

Appearance on the board is not our opinion of a person, product, or price. We do not verify that listed items, claims, or sellers are true. Visitor counts describe what the platform shows or records; they are not a promise that you will get the same outcome. Your results depend on your listing, pricing, timing, and factors we do not control.

Availability and changes

We provide the Service as-is. It may be unavailable, slow, or incorrect. We may change ranking rules, categories, or these Terms. If a change is material, we will update the date at the top of this page. Continued use after a change means you accept the new Terms.

Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that listings, messages, or counts are accurate or complete. We do not inspect items, verify identities beyond ordinary account checks, or guarantee any meet-up or sale.

Limitation of liability

We do not limit liability that applicable law says we cannot limit. Subject to that, we are not liable for lost profits, lost data, lost goodwill, substitute services, or other indirect, incidental, special, or consequential damages. Our total liability for a claim related to the Service is limited to one hundred Ghana cedis (GH₵ 100).

Indemnity

You will defend, indemnify, and hold harmless Ogua and people working on the Service from claims, damages, losses, and reasonable legal fees arising out of your listing, your item, your dealings with a buyer or seller, your breach of these Terms, or your infringement of someone else's rights.

General

If a part of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service. These Terms, the Safety tips, and the Privacy Policy form the entire agreement for the Service. We do not process payments; any hosting, email, and analytics providers we use are third parties whose outages or decisions are outside our control.
